Expert View: How to Prepare for the Trans-Atlantic Data Privacy Framework?

The Trans-Atlantic Data Privacy Framework is the most recent in a long series of laws that have been declared null and void by the European Court of Justice. The current law, which has been in force since July 2023, is already pending in court. Users of US cloud services, in particular, are therefore facing uncertain times again – at least in theory, as the growth in the cloud environment does not necessarily suggest any restraint outside of the public sector and a few other highly regulated sectors. In order to avoid the debate about Safe Harbor, Privacy Shield, and now the Trans-Atlantic Data Privacy Framework, most US cloud providers have now set up mostly separate cloud data centers in Europe, which complies with European data protection regulations, at least theoretically.
